Terms of Service

1. Acceptance and scope

These Terms of Service (Terms) govern your use of EarnRush, including our website, member dashboard, offers, rewards, support channels and withdrawal features (collectively, the Service). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you use EarnRush on behalf of an organisation, you confirm that you have authority to accept these Terms for that organisation. If you do not agree, do not create an account or use the Service.

2. Eligibility and accounts

You must be at least 16 years old, meet the age of majority for the activities and payout methods available in your location, and be permitted to use the Service under applicable law. Some offers, partners and payout methods may impose higher eligibility requirements.

Provide accurate account information, keep your login credentials secure, and use only one EarnRush account unless we approve otherwise in writing. You are responsible for activity performed through your account. We may require reasonable information to verify account ownership, eligibility, rewards or withdrawals.

3. Offers and rewards

EarnRush makes third-party offers, games, surveys and partner activities available to eligible members. Offer availability, requirements, value, timing and eligibility are determined by the relevant partner and may change or end without notice.

Starting or completing an offer does not guarantee a reward. A reward becomes available only after EarnRush receives and accepts the relevant partner confirmation and completes any required review. We may place rewards in Pending or Held status while confirming completion, investigating a dispute, applying partner requirements or meeting legal, risk or operational obligations.

Unless an offer states otherwise, 1,000 EarnRush points represent US$1.00 of reward value. Points and displayed balances are not bank deposits, stored-value accounts, securities, cryptocurrency, or legal tender. They are limited contractual reward balances that may be redeemed through available EarnRush withdrawal options.

4. Withdrawals and manual review

Withdrawal methods, minimums, regions, fees and availability are shown in the Service and may change. You are responsible for providing an accurate payout address, account or gift-card region. Cryptocurrency transfers can be irreversible; EarnRush is not responsible for a loss caused by an inaccurate destination provided by you.

At launch, withdrawals are manually reviewed and processed. A withdrawal request reserves the requested available balance while it is under review. We may approve, reject, cancel, delay or request further information for a withdrawal where required to protect members, partners, EarnRush or the integrity of the Service. A completed withdrawal is final once the applicable external transfer or fulfilment is confirmed.

5. Fair use and prohibited conduct

You must use EarnRush honestly and only for your own genuine participation. You must not create multiple accounts, impersonate another person, provide false information, use automation to complete offers, manipulate tracking, evade geography or eligibility restrictions, interfere with the Service, exploit an error, resell rewards, or attempt to obtain rewards that you did not genuinely earn.

You must not use the Service for unlawful, abusive, deceptive, infringing or harmful conduct. We may reverse affected rewards, cancel withdrawals, suspend access, close accounts and cooperate with lawful requests when we reasonably believe these Terms or applicable law have been breached.

6. Third-party services

Offers, hosted offerwalls, Google sign-in, gift cards, cryptocurrency networks and other third-party services are provided or operated by independent parties. Their own terms, privacy notices, eligibility criteria and technical conditions apply. EarnRush does not control, endorse or guarantee third-party content, availability, tracking decisions or products.

When you leave EarnRush for a partner destination, your dealings with that partner are between you and that party. Contact EarnRush support if you need help with an EarnRush account, reward status or withdrawal request.

7. Communications

By using the Service, you agree that we may send service-related communications about your account, rewards, withdrawals, support requests, security and material updates by email or through the Service. You can manage non-essential marketing preferences where available, but you cannot opt out of essential account and transaction communications while maintaining an account.

8. Suspension, termination and changes

You may stop using EarnRush at any time. We may suspend or terminate access, remove offers, refuse a withdrawal, reverse an invalid reward or close an account where reasonably necessary for security, partner compliance, legal requirements, abuse prevention or a breach of these Terms.

We may update the Service or these Terms from time to time. If a change is material, we will provide notice through the Service or by email when practicable. Continued use after an updated effective date means you accept the revised Terms.

9. Disclaimers and limitation of liability

The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not promise that every offer will track, that every third-party service will remain available, or that the Service will be uninterrupted or error-free.

To the fullest extent permitted by law, EarnRush and its operators are not liable for indirect, incidental, special, consequential or punitive losses, including lost rewards, lost profits, data loss or losses caused by a third party. Nothing in these Terms excludes rights or liabilities that cannot be excluded under applicable law.

10. Governing law and contact

These Terms are governed by the laws of the jurisdiction in which the EarnRush operating entity is established, without regard to conflict-of-laws rules. Courts with jurisdiction over that operating entity will have exclusive jurisdiction, except where consumer law gives you a non-waivable right to bring a claim elsewhere.
